Concurrent insanity can be used as a defense in a criminal trial. The defense must present evidence that the defendant was suffering from a mental disorder during the time of the crime and that their mental state prevented them from understanding the wrongfulness of their actions. For example, the defendant may have suffered from post-traumatic stress disorder at the time of the crime, which caused them to act impulsively and without realizing the consequences of their action. In such a case, the court may find the defendant not guilty due to concurrent insanity.
In order for the defense of concurrent insanity to be successful, it must be proved that the defendant was insane at the time of the crime and there must also be evidence of a causal link between the mental disorder and the crime.
